3.      Agreement between Customer and Seller

3.1.   When you place an order for a product on our website, you make an offer to purchase the product. We accept your offer by sending you an order confirmation email.

3.2.   A contract for the sale and supply of goods is entered into between You (the Customer) and the Seller if you make payment in full (including any delivery charges as applicable) on the Website for the goods or services (or both) in your cart, and the Order is accepted and confirmed by the Seller.

3.4.   If your Order has not been accepted by the Seller, the Seller will notify you as soon as possible by email or telephone and arrange a full refund of any payment made by You to be processed.

3.5.   Any indications of stock levels are accurate with the last known stock level and are subject to change.

3.6.   The Seller may at its sole and absolute discretion, accept or reject any offer made by You for any reason (or without reason), including errors in adverted price or description of goods on the Website.

3.7.1.  You or the person installing the products purchased are suitably qualified to diagnose appliance faults and install any supplied products from the Seller.

3.7.2.  You or the person installing the products purchased will not hold the Seller responsible in any capacity for any misdiagnosis of faults.

3.7.3.  Electrical items must be installed only by suitably qualified and licensed persons.

3.8.   You agree to indemnify, defend and hold harmless the Seller, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages, consequential losses (direct or indirect) and/or costs (including, but not limited to, legal fees) arising from the installation of products by unqualified persons.

 

4.      Pricing

4.1.   All prices are in Australian Dollars (AUD) and are inclusive of Goods and Service Tax (GST) where applicable.

4.2.   Prices shown with each good do not include delivery and handling charges and we reserve the right to change the prices of our products at any time without prior notice.

4.3.   The Seller reserves the right to correct any errors on the Website.

 

5.      Payment

5.1.   Payment must be made and received in full prior to acceptance of an Order by the Seller.

5.2.   Payment must be made through the Website using the accepted payment methods offered on the Website.

5.3.   To the extent permitted by law, the Seller will not be responsible for any damages or consequential losses suffered by a User through the fraudulent or unauthorised usage.

 

6.      Delivery

6.1.   Delivery charges (if any) are calculated at checkout based on the delivery address supplied by the User.

6.2.   Should an incorrect delivery address be supplied by the Customer at checkout or should the delivery address need to be altered at the request of the Customer after placing the order, the Seller may need to charge additional shipping costs based on the new delivery address.

6.3.   Delivery timeframes shown on the Website are provided as estimates only and are subject to change based on third party delivery carrier timeframes.

6.4.   Risk of loss for goods in the Order pass to You upon delivery to the delivery carrier.

 

7.      Returns and Refunds

7.1.   The Seller requires that all products be inspected upon delivery and any alleged damage or defect be reported to the Seller within 5 days from the order delivery date for any returns to be considered.

7.2.   The Seller may request evidence of any alleged product damage or defect which the Customer agrees to provide, including but not limited to, photographic and diagnostic logs.

7.3.   Customer is responsible for return freight charges of products to the Seller.

7.4.   Customer agrees that the products sold by The Seller are acquired to be used for the repair of other products and are to be purchased only by suitably qualified persons for the sole purpose of repairing other products.

7.5.   Electronic items must be installed by a suitably qualified person licensed to perform electrical repairs. If the Customer wishes to claim a return or refund for electrical products, the Customer agrees to provide, upon request, an invoice from a suitably qualified person itemised with works undertaken and parts used.

7.6.   Electronic components and circuit boards are unable to be returned. Customers should ensure products are suitable prior to placing an order.

7.7.   Refunds will only be processed using the original payment method.

 

8.      Intellectual Property Rights

8.1.   Ownership: This website contains material that is owned by or licensed to us. This material    
includes, but is not limited to, the design, layout, look, appearance, and graphics.  Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms.
